Italy opens a probe into Suno's license scope and moral-rights waiver. Read the clauses before commercial delivery (investigation, not a finding)
On 6 October 2026 Italy’s AGCM opened case CV278 into Suno Inc.’s Terms of Service, asking whether clauses may be unfair under Consumer Code Article 33. Issues include an all-encompassing copyright license and a moral-rights waiver. An investigation, not a finding of unlawfulness.
What happened
On 6 October 2026 the Italian Competition Authority (AGCM, which also handles consumer protection) opened an investigation into Suno Inc.’s Terms of Service for possible unfair clauses under Consumer Code Article 33 (case CV278). This is the opening of a probe, not a finding of unlawfulness. A public consultation for trade and consumer associations is due in the coming weeks.
What changed
MBW notes the current Suno terms took effect on 3 September. The live text at suno.com/terms, checked for this note, has users irrevocably waive moral rights / droit moral in the Content and Voice Model, and grant Suno a perpetual, irrevocable license. What is new is AGCM formally questioning that license as generic and all-encompassing, and as a moral-rights waiver that may conflict with Articles 20 et seq. of Italian Law 633/1941.
Whose work this affects
Commercial license and credit. Producers delivering or distributing Suno output need to read, in the terms tied to their own account, what license remains with Suno and the moral-rights waiver. AGCM also flagged unilateral changes to the contract, service, and subscription prices; account suspension for any reason; U.S. binding arbitration; a class-action waiver; and exclusive Massachusetts jurisdiction. An Italian probe is not a Japanese-law conclusion.
