Kominami の楽曲を使うときのルールです。商用・非商用の完成物で利用できますが、音源の再配布や長時間Mix等の主コンテンツ利用は禁止です。

License Overview

Rules for using Kominami royalty-free tracks. Free for commercial and non-commercial finished works, with restrictions on redistribution and music-only use.

ご利用前にご確認ください

  • 本サイトの音源をダウンロード・再生・利用した時点で、本ライセンスおよび利用規約に同意したものとみなします。
  • 案件要件と本ライセンスが矛盾する場合は、利用前にお問い合わせください。

用語の定義

  • 「音源」とは、本サイトで公開するBGM・ボーカル・ビートおよび関連メタデータを指します。
  • 「運営カタログ音源」とは、Kominamiが運営として公開する音源を指します。
  • 「コミュニティ音源」とは、投稿者がコミュニティ投稿フローでアップロードした音源を指します。
  • 「背景利用」とは、動画・配信・ゲーム・アプリ・イベント・資料等で主コンテンツを補助する利用、および店舗・施設内の背景音楽として再生する利用を指します。
  • 「主コンテンツ利用」とは、音源自体を主価値として提供・配信・販売する利用（長時間Mix、音源をまとめた再投稿動画、作業用BGM集、音源集チャンネル、素材再配布等）を指します。
  • Beatについては、ご自身の歌詞・ラップ・ボーカルを加えて新しい完成楽曲を制作する利用を認め、禁止される主コンテンツ利用には含めません。

コミュニティ音源について

  • コミュニティ音源は運営カタログと同じ一覧に表示されますが、権利バッジが異なります。
  • コミュニティ音源は、投稿者が投稿ライセンスへ同意して必要な権利を申告したうえで、運営が申告内容・楽曲情報・音源・明らかな問題を確認する掲載審査を行ってから公開します。
  • 審査を通過したコミュニティ音源にも、商用利用を含むKominamiの公開ライセンスが運営カタログ音源と同様に適用されます。
  • 掲載審査は投稿者の完全な権利関係を独自に立証するものではなく、法的判断や第三者から権利申立てが起きないことを保証するものでもありません。

利用できる範囲

  • すべての公開音源は、動画・ゲーム・配信・ポッドキャストなど、商用・非商用の完成物で無料利用できます。
  • クライアント案件や法人プロジェクトでも追加費用は不要です。
  • 店舗、飲食店、ホテル、オフィス、病院・クリニック、サロン、ジム、学校、展示会場その他の施設内で、来店者・利用者向けのBGMとして再生できます。商用施設でもKominamiへの利用回数・拠点数ごとの追加料金は不要です。
  • コーディングAIやAI支援ワークフローで制作したゲーム、アプリ、動画、試作への組み込み利用も同条件で可能です。
  • クレジット表記は任意です。記載する場合の例：Music: 曲名 — 投稿者名 (Kominami)。
  • 編集利用（カット、フェード、音量調整、形式変換、軽微なエフェクト）は可能です。
  • Beatは、ラップ・歌入れ、楽曲制作、デモ制作、およびご自身の歌詞・ボーカルを加えた完成楽曲の商用リリースに利用できます。
  • サイト上で公開終了した後も、公開中に適法に取得した音源は本ライセンス範囲で利用できます。

ライセンス対象外

  • 無加工の音源そのものを主目的にした公開・配信・販売（Beatへオリジナルの歌詞・ボーカルを加えた完成楽曲を除く主コンテンツ利用）。
  • Kominamiの音源を主な視聴目的にした長時間Mix、音源をまとめた再投稿動画、作業用BGM集、音源集チャンネル等。
  • 第三者が再利用できる形での再許諾が必要な組み込み利用（素材配布テンプレート等）。
  • 独占利用・権利譲渡・著作権移転を前提とする利用。

禁止事項

  • 音源データをそのまま再配布・販売したり、自作発言で販売する行為。
  • 本サイトの音源をまとめて、長時間Mix、作業用BGM集、音源をまとめた再投稿動画、音源集チャンネル、素材パックとして再公開・再配布する行為。
  • 本サイトの音源を YouTube Content ID や類似の権利主張システムに登録する行為。
  • AIの学習データに再利用したり、AI生成素材として再配布する行為。
  • ヘイト・違法・公序良俗に反するコンテンツでの使用、過度な負荷を与える自動ダウンロード等。
  • 音源の抽出を容易にする形で生データを公開する行為、著作者表示を偽る行為。
  • Beatを使った完成楽曲をContent ID等へ登録し、元のBeatに対する権利を主張したり、他の正規利用者を妨げたりする行為。
  • 作曲者・権利者の名誉を毀損する用途、各プラットフォーム規約に反する用途。

生成AIの利用について

  • メロディーは生成AIで作り、人の耳でチェックしてから公開します。
  • 品質向上や権利保護のため、予告なくデータを差し替える場合があります。
  • AI由来の仕様変更によるトラブル等については免責とさせていただきます。

権利帰属と利用者責任

  • 著作権・著作隣接権等の権利はKominamiまたは作曲者に帰属します。
  • 本ライセンスは利用許諾であり、権利譲渡・独占利用権の付与は行いません。
  • 最終的な利用可否（広告審査、配信規約、各国法令への適合）は利用者ご自身の責任で確認してください。

保証・免責

  • 音源は現状有姿で提供され、継続提供・特定目的適合性・完全な非侵害を保証するものではありません。
  • 法令上許容される範囲で、Kominamiは間接損害・特別損害・結果損害を含む責任を負いません。
  • 権利者またはプラットフォーム運営から申し立てがあった場合、対象音源の利用停止をお願いすることがあります。

準拠法・お問い合わせ

  • 本ライセンスは日本法に準拠します（強行法規が優先される場合を除く）。
  • 利用可否や契約確認は [email protected] までご連絡ください。
  • 本ライセンスは予告なく改定されることがあります。改定後の利用は改定内容への同意とみなします。

Before you use tracks

  • By downloading, streaming, or otherwise using any track on this site, you agree to this license and the Terms of Service.
  • If project requirements conflict with this license, do not use the track until you contact us for confirmation.
  • This page is a practical summary for creators; legal interpretation follows the Terms of Service.

Definitions

  • “Track” means audio files published on this site (BGM, vocal, beat, and related metadata).
  • “Kominami catalog track” means a track published by Kominami as operator content.
  • “Community track” means a track uploaded by a creator through the community submission flow.
  • “Background use” means using tracks as a supporting element in videos, streams, games, apps, events, presentations, podcasts, or as in-facility background music.
  • “Primary-content use” means using tracks as the main value of the content itself (long-form mixes, music-only uploads, playlist-style reupload videos, BGM collection channels, stock redistribution, audio asset packs, etc.).
  • For Beat tracks, adding your own lyrics and vocals to create a new finished song is permitted and is not treated as prohibited primary-content use.

Community tracks

  • Community tracks appear in the same catalog as Kominami catalog tracks, but with a different rights badge.
  • Community tracks are published only after the creator accepts the submission license, declares the required rights, and Kominami completes a publication review of the declaration, metadata, audio, and obvious issues.
  • The public Kominami License, including commercial use, applies to approved community tracks in the same way as operator catalog tracks.
  • Publication review does not independently establish the creator's full chain of rights. It is not a legal opinion or a guarantee that no third-party rights claim will occur.

Allowed uses

  • All published tracks are free for commercial and non-commercial finished projects (video, games, streaming, podcasts, etc.).
  • No additional fees are required for client projects or corporate use.
  • Tracks may be played as background music in shops, restaurants, hotels, offices, clinics, salons, gyms, schools, exhibition venues, and other facilities. Commercial facilities may use them without per-use or per-location fees payable to Kominami.
  • Use inside games, apps, videos, and prototypes made with AI-assisted workflows is allowed under the same terms.
  • Credit is optional. When practical, use: Music: [Track title] — [Creator] (Kominami).
  • Editing for production is allowed (trim, fade, level adjustment, format conversion, light effects).
  • Beat tracks may be used for rap vocals, songwriting, demos, and commercial release of a finished song containing your own lyrics or vocals.
  • Use remains valid for files already downloaded, even if a track is later unpublished from this site.

Not covered by this license

  • Primary-content use where the unaltered track itself is the core product or attraction, except permitted finished songs made by adding original lyrics or vocals to a Beat track.
  • Long-form mixes, music-only uploads, playlist-style reupload videos, or BGM collection channels where Kominami tracks are the main listening content.
  • Cases that require sublicensing to downstream end users (tools/platform templates with reusable raw audio).
  • Any use requiring exclusive rights transfer or ownership transfer.

Prohibited

  • Redistributing audio as-is or selling as a standalone asset; claiming authorship.
  • Reuploading or compiling tracks as music-only videos, long-form mixes, playlist-style reupload videos, BGM collections, BGM channels, or audio asset packs.
  • Registering tracks from this site in YouTube Content ID or similar rights-claim systems.
  • Reusing tracks for AI training datasets or redistributing them as AI-generated assets/materials.
  • Use in hateful, illegal, or offensive content; excessive server load or automated scraping.
  • Uploading tracks as your own catalog, publishing stems/raw files for third-party extraction, or bypassing protection to expose source audio.
  • Registering a finished song that uses a Beat track in Content ID or another rights-claim system in a way that claims or blocks the underlying Beat.
  • Uses that may defame creators, mislead rights attribution, or violate platform policy/law.

About AI-generated music

  • Melodies are generated with AI, then reviewed and released by humans.
  • Tracks may be updated/replaced without notice to improve quality or protect rights.
  • We are not liable for issues caused by AI platform changes beyond our control.

Rights and responsibility

  • Copyright and related rights remain with Kominami and/or the original creator.
  • This license grants permission to use tracks within scope; it does not transfer ownership or exclusive rights.
  • You are responsible for confirming your final use complies with platform rules, ad network policies, and local law.

Warranty and limitation

  • Tracks are provided “as is” without warranty of uninterrupted availability, fitness for a specific purpose, or non-infringement in every jurisdiction.
  • To the maximum extent permitted by law, Kominami is not liable for indirect, incidental, special, or consequential damages from track use.
  • If a dispute/claim occurs, users must promptly stop use of the affected track upon request from rights holders or platform operators.
